Council delays action on city-owned affordable unit covenant after resident complaints about safety

The Aliso Viejo City Council voted to pull and continue agenda item 4.8 concerning a restrictive affordable-housing covenant on a city-owned unit at 38 Colonial after neighbors described safety and nuisance problems and staff said the city is coordinating with Family Assistance Ministries (FAM) on eviction.
A Van Tis homeowners association representative told the council the property has had frequent police and fire responses, reports of drug activity, and repeated disturbances affecting neighbors. Councilmembers asked staff for a fuller accounting of police contacts and eviction status before deciding whether to place a long-term restrictive covenant (which staff said is required to demonstrate to the State that the city’s PLHA/related grant-funded units remain restricted for an extended period).
City staff confirmed that the unit was purchased with CDBG/PLHA grant funding and that the absence of a recorded covenant could jeopardize release of some maintenance funding; staff said they had just learned of the eviction action and are evaluating next steps. Councilmember motioned to continue the matter to allow staff to gather police-activity data, legal input and the HOA’s documentation; the motion carried unanimously.
Council emphasized balancing tenant screening, resident safety and preserving affordable housing, and directed staff to bring back detailed information at the next meeting.
