The Zoning Board of Appeals opened a new public hearing for FY2605 to consider an appeal by an applicant identified as Kayson (speaker 5), who seeks to operate a small vehicle dealership/auction sales from a newly built garage at 74 Henry Street in an industrial zoning district. The building inspector raised questions about whether the lot can support two principal uses (residence plus retail dealership) or whether a dealership would be a prohibited second principal use rather than an accessory activity.
The applicant described the proposal as "to go to the auction to sell 1 or 2 cars" and said similar activities exist nearby. Board members discussed that because the property is in an industrial district and has a grandfathered residential use, the key legal question is whether the lot may permissibly host two principal uses. Several members suggested consulting town counsel and noted the applicant could split the lot or seek other remedies if necessary. The applicant asked to continue to the board—s Nov. 5 meeting to gather counsel and supplemental materials; the board granted the requested continuance and advised the applicant to submit backup materials in advance to staff for review.
No final determination was made at the Oct. 1 hearing.
