The Taunton Zoning Board of Appeals voted to grant a variance to homeowner Cody Ponce to build a two-car garage at 34 Hebert Street, allowing an 11-foot side setback instead of the 15-foot requirement and a 23-foot front setback rather than 25. Ponce told the board he grew up in the house and needs additional space for his family.
Board members asked technical questions about the plans and whether the garage could be pulled back; Ponce said his architect recommended aligning the garage with the porch roof line. The board read departmental comments into the record, including a note that a certified plot plan will be required by the city engineer to obtain a building permit. The board nevertheless voted to waive a submission requirement for this petition.
"I bought off my grandparents and my parents now. I just my twins are 3 years old now. We quickly grew out of space," petitioner Cody Ponce said.
A motion to approve the variance as presented carried unanimously. The board chair advised Ponce that city staff would contact him and that the 20-day appeal period begins once documentation is finalized.
Procedural notes: the board waived the internal submission requirement for this petition during its deliberation; separate building-permit requirements cited by the city engineer (including a certified plot plan) remain in effect and must be satisfied before any construction permit is issued.
