The matter involved an after‑the‑fact RDA and enforcement order for construction already completed around a residence — including a 33.7 × 45.1‑foot patio, a 6‑foot walkway, a crushed‑stone path and a second‑story floating deck addition — that encroached into the 100‑foot buffer to a bordering vegetated wetland. Attorney and staff noted the area had been previously disturbed and that the applicant followed through with required flagging; the applicant’s representative, Ronald Dunn of MBLM Development, presented the post‑construction survey and a reset of wetland flags.
Commission members emphasized that the owner should consult with staff before doing future work and encouraged compliance with permit processes. After discussion, the commission voted to remove the enforcement action and to issue a negative determination for the after‑the‑fact filing with attached special conditions that include flag verification, protection of erosion controls and standard mitigation measures.
The commission recorded that recipients must meet those conditions or face re‑opened enforcement steps; staff will monitor timetables and flag placement to ensure compliance.
