The LaPorte County Drainage Board heard on Sept. 9 that county legal staff sent a cease-and-desist letter last week to a property owner tied to drainage concerns, and that the board should wait for certified-mail confirmation before taking further action. The board asked staff to inspect the site and return with an update.
Board members debated whether an HOA exists for the affected subdivision. One member said resident Gene Schwartz told them there is no homeowners association in place; based on that account the board discussed whether to send a letter to all homeowners or wait for confirmation from any HOA representative. The member said an email was also sent to a person named Nancy Frigo, who has attended prior meetings but had not responded.
County legal staff reported the certified-mail receipt (green card) had not yet been returned; legal counsel recommended waiting about a week after receipt of that return before additional enforcement steps. Board members directed staff to follow up with site visits and, if desired, to circulate further communication to the property owner or homeowners once legal confirms delivery.
The board did not take immediate enforcement beyond the mailed notice; it asked staff to inspect the site, verify whether water is currently flowing from the property, and report back at the next meeting.
