Bluffdale council approves settlement to acquire Newman property for 1000 West widening

Bluffdale’s City Council on Tuesday approved a negotiated settlement to resolve a condemnation lawsuit and acquire land needed for the reconstruction and widening of 1000 West/4600 South where the roadway passes under the railroad.
City attorney Fred presented terms of the agreement, saying the city will purchase roughly 0.997 acres (about 43,428 square feet) by special warranty deed at $24 per square foot and obtain a temporary construction easement of about 0.678 acres (29,534 square feet). The easement will be used for construction staging, including a crane path; the city will pay about $5,900 per month for use of the easement once the city gives notice it will occupy the property. The Newmans also receive an option to purchase certain parcels that are created after the road is relocated east, and they may have the option to buy portions of fee property the city does not ultimately need.
Fred told the council the agreement will allow the parties to dismiss the lawsuit and proceed with the project. Council members asked technical questions about grading and retaining walls; staff confirmed the design will use a slope rather than a retaining wall.
Council Member Wilding moved to approve Resolution 2025-76. The motion passed on a roll-call vote with each council member present recorded as voting yes. Staff said the city will execute documents and record them and then file dismissal documents with the court to close the litigation and proceed with construction work as soon as practical.
The settlement authorizes staff to complete the necessary documents and begin the recordation and dismissal steps that will free the city to move forward on the roadway reconstruction project.
