The Hastings Utility Board on Sept. 11 recommended the council approve Amendment No. 4 to the coal-supply agreement with AGP. Staff summarized the amendment as a set of clarifications and small adjustments to quantity and scheduling terms: it slightly lowers the contract’s minimum and maximum take quantities (Section 4), clarifies procedures for additional coal purchases and invoicing (Sections 6 and 15), and revises penalty language (Section 20) to tie penalties to the average coal-inventory price rather than a fixed minimum amount.
Staff said the changes are mostly clarifications that make invoicing and excess-take calculations align with current practice and that the adjustments reduce friction without materially changing bargaining power. Shane told the board the amendment does not present concerns for Hastings Utility’s negotiating position and recommended approval.
A motion to recommend approval was moved, seconded and carried by unanimous voice/roll-call votes recorded as 'Yes' from Heitzman, DeWalt, Mieske and Kohl's.
The amendment was characterized by staff as lowering the utility’s minimum and maximum take obligations slightly and aligning penalty calculations to the utility’s existing inventory-price methodology; staff said the volume involved is less than roughly 10% of burn for Wayland units 1 and 2 and that unit additions have reduced the contract’s relative materiality compared with earlier years.
