Commission forwards UDC amendment changing where dwellings above ground floor are allowed

Development Services presented a zoning-text amendment Sept. 8 to revise portions of the Unified Development Code (articles 4, 8, 15 and 17), including changes to how "dwelling above the ground floor" is permitted across commercial districts.
Mr. Moore said the current code allows dwelling above the ground floor by right in all commercial districts (C1–C5, CD, CG). The proposed revision would remove that by-right allowance in C1, C2 and C3, require a special-use approval in C4 and C5, and retain the use by right in CD and CG, which staff described as higher-intensity mixed-use districts designed to foster pedestrian-friendly development. "The proposed revision would no longer allow it in C1, C2, and C3," Moore said.
Staff recommended forwarding ZTA 18 89-2025 to the Board of Mayor and Aldermen with a recommendation to approve; Commissioner (Speaker 8) moved to favorably recommend ZTA 18 89-2025 and the commission approved the recommendation.
The amendment will next be considered by BOMA as a policy and zoning-text matter; the planning commission's vote was a recommendation, not final action.
