Staff urges calling Ketron Square performance bonds if road work not finished by Oct. 14; developer asks for deferment

Spring Hill staff told the Planning Commission Sept. 8 that developer work on Ketron Square (School Street and Kidron Road) has not made substantial progress and recommended forwarding a request to the Board of Mayor and Aldermen to call performance bonds if required improvements are not finished by Oct. 14.

Staff described School Street as closed and in an "unacceptable condition," said Kidron Road paving did not meet city standards, and raised stormwater and drainage issues that create ponding and safety risks. Staff recommended the city call the bonds and use bond funds to complete required improvements if the developer has not finished work by the Oct. 14 deadline stated by the developer.

Developer Peter Riffley identified himself and asked the commission to defer votes on the two resolutions until the next meeting, saying crews were actively working (storm structures had arrived, waterline potholing was underway and base work for concrete was being placed) and staff had requested a minor plan modification to clarify sidewalk requirements. "I'm speaking today to ask that we defer the vote on the 2 resolutions until next month's meeting," Riffley said.

Commission discussion noted that the planning commission's action is a recommendation to BOMA and that BOMA offers additional timing flexibility; commissioners voted to forward a favorable recommendation to BOMA on Resolution 25 73 authorizing staff to pursue calling the bonds should improvements remain incomplete after Oct. 14.

The Planning Commission did not itself call the bond; it forwarded a favorable recommendation to BOMA as requested by staff.
