The Peculiar City board voted to continue a public hearing on a proposed matter at 355 Trackside Drive after staff said a clerical error prevented adequate notice to surrounding property owners.
Staff member (Speaker 4) told the board that case number 250113 had been noticed in the newspaper but that an error in mailing required the city to reissue notices and give neighbors more time to respond. "Staff did notice this in the newspaper. However, there was a clerical error on our end, and so staff does recommend the continuance of the public hearing to a date certain of October 16," Speaker 4 said.
The continuation will give staff time to resend notices to nearby property owners; Speaker 4 reported the office had already started receiving returned mail indicating recipients did not accept mail at the listed addresses. When a board member asked whether new evidence or different materials would be presented at the rescheduled hearing, Speaker 4 said the case materials would be the same and the issue was limited to distribution of notices.
Speaker 3 made the motion to continue the hearing to Oct. 16 and Speaker 1 seconded. The board then conducted a roll-call vote. Chairman Gillespie, Vice Chairman Wilson, Board member Harrison, Board member Kelly and Board member Clawson each voted in favor, and the motion carried.
The public hearing for case no. 250113 (355 Trackside Drive) is now set for Oct. 16; staff will reissue notice to surrounding property owners before that date.
