The Creve Coeur City Council unanimously approved bill 6169, an ordinance amending the site concept plan and subdivision plan for Olya Village in Creve Coeur, after adding an amendment requiring developers to assign construction warranties on public streets to the city.
During discussion, a councilmember raised concerns about when streets become public and who bears responsibility for damage caused during construction. Staff explained that streets are inspected and, once accepted, become eligible to be maintained by the city; builders must post a site-improvement escrow for 100% of approved improvements under the city’s ordinance, which can cover damage to public property. "When we issue a site improvement permit... they’re required to post an escrow covering 100% of the value of those approved," an unidentified staff speaker said.
A motion to add a provision (4-2) assigning construction warranties to the city was offered and seconded; the amendment passed and was folded into the ordinance. After questions from developer Matt Fond (Jack Matthews Development) about inspection procedures, staff said contracted consultants and on-site inspectors monitor construction daily and will coordinate routes and timing to minimize damage as lots are developed individually. The council then voted to pass bill 6169 as amended.
The action requires developers to provide financial protection and warranty assignment to limit the city’s exposure for post-acceptance defects or damage; staff said further permit-level discussions will occur as individual lots advance to construction.
