Staff to draft clarifying rules for mobile vendors; commission discusses rural event-venue conditions

Powhatan County planning staff told the commission they will draft ordinance language to clarify how mobile vendors are regulated after a citizen asked whether flower trucks should be allowed.

Planner Sean Clendening said the current zoning interpretation treats sales from vehicles as prohibited retail vehicle sales unless the vendor operates from property where the ag grower already conducts sales (a roadside stand). "Food trucks," he said, have generally operated under an informal staff interpretation that allows limited accessory use for businesses in districts that permit eating and drinking, or under temporary-use permits for events. Staff proposed drafting code language to define and distinguish ag-based mobile vendors (including flower trucks) from other retail-vehicle sales and to set clear standards such as business licensing and location/parking criteria.

On rural event venues, staff noted existing use standards that include a 200-foot property-line setback and 300 feet from any adjacent residential dwelling; the code currently prohibits amplified outdoor music. Commissioners discussed whether conditional-use permits could allow narrowly defined and conditioned exceptions (specific hours, decibel limits, and annual reviews). Some commissioners warned that allowing exceptions could create precedent problems for narrow 10-acre lots that could not meet separation standards.

Next steps: staff will prepare draft ordinance language on mobile vendors for the commission to review next month and will be prepared to discuss any referral the Board of Supervisors makes about event-venue rules.
