At its meeting the Accomack County School Board used closed-session authority under the Virginia Freedom of Information Act (Va. Code §2.2-3711) to address a slate of legal and personnel matters, then voted on several formal actions when it returned to open session.
Member (speaker 2) moved the board into a closed meeting to discuss a Mapsville property, probable breach of contract litigation related to transportation, potential settlement of employment litigation pending in Accomack County Circuit Court, proposed revisions to the student code of conduct, and student disciplinary hearings. After the closed session the board certified that only items identified in the motion had been discussed, per Va. Code §2.2-3711.
In open session the board approved multiple items: a long-term suspension case (O8052501), the personnel list as amended (the roll-call record shows several yes votes and at least one no), authorization for the board chair to execute an agreement of purchase and sale for the Mapsville property, initiation of litigation in state court concerning a breach of a transportation agreement, and authorization for the chair to execute a settlement agreement resolving employment litigation currently pending in Accomack County Circuit Court. Several motions were made by Member (speaker 2) and seconded; the meeting record indicates the motions carried.
The board also moved personnel matters to the end of the meeting and approved the personnel list after the second closed session. The personnel discussion referenced numerous personnel items to be considered in closed session, including professional and classified appointments, retirements, resignations, status changes, and substitute appointments. The exact names, dollar figures for the settlement, and detailed legal pleadings were not read into the public record during the open session; the board limited public discussion to the actions authorized and certified compliance with the open-meeting law.
