The Emeryville Planning Commission on Aug. 28 unanimously approved a one‑year extension of entitlements for the Bay Center life‑science development, a proposed six‑story R&D building and associated parking in the city’s north industrial area.
Planning Manager Miri Desai told commissioners the original entitlements were approved in 2023; the applicant requested a final 12‑month extension to allow more time to secure construction financing amid current market conditions. Staff recommended the extension and said the permit package includes: a use permit for bonus height (up to 96 feet), design review approval, and a tree‑removal permit tied to street reconfiguration along 60th Fourth and 60th Fifth streets.
Desai presented project figures: the development needs 92 bonus points; because it is not housing, the project would pay a fee in lieu of providing affordable housing on site — roughly $2,000,000 under current calculations, with the final fee set at building‑permit issuance. Staff also identified approximately $4,400,000 in monetized community benefits, including contributions toward Lacoste Park and the city’s small‑business fund, plus new open space (a dog run and public plaza) that would be developed by Public Works using applicant contributions.
No members of the public spoke during the public comment period. Commissioner Gould moved to approve the one‑year extension; Commissioner Small seconded. The roll call vote was unanimous.
Staff noted this would be the project’s final entitlement extension; after the authorized extension the applicant must apply for a building permit within one year to keep the approvals active.
