At its Sept. 4 meeting the Planning and Zoning Commission approved three zone changes and granted a waiver to a screening-fence requirement; each approved item will be forwarded to City Council for first reading on Sept. 23 at 2 p.m., unless noted.
Summary of formal actions
- Zone case 0774c (Iglesias del Dios Vivo): Request to rezone a property west of Martin Luther King Jr. Boulevard and south of 50th Street from Light Industrial to Neighborhood Commercial. After staff presentation (Jamie McGar) and an applicant statement by Jesus Tejeda, the commission moved to approve the request; vote 7–0. The item will go to Council for first reading Sept. 23 at 2 p.m.
- Zone case 3116‑M (SK Architecture Group LLC for JSJW Holdings LLC): Request to downzone from Heavy Commercial to Neighborhood Commercial near 130th Street and Knoxville Avenue. Gabriel Sanchez (SK Architecture) described the proposed strip-center plans and compatibility with adjacent residential uses; staff had no objection. Motion carried 7–0. The item will go to Council first reading Sept. 23 at 2 p.m.
- Zone case 3533 (Mountain Top Engineering LLC for Fort Patel et al.): Request to rezone 1.55 acres at Milwaukee Avenue and 104th Street from SF‑2 to Neighborhood Commercial for a proposed strip center. Adam Nixon (Mountaintop Engineering) presented; no opposition appeared at the hearing. Motion carried 7–0 and will be forwarded to Council Sept. 23.
- Screening-fence waiver (item 4.1): Collier Construction requested a waiver of the former-code requirement for a 6‑foot solid wood or masonry screening fence at Prosperity Bank, 10909 Slide Road. Applicant Scott Collier said the bank and the adjacent Primrose daycare preferred to keep an open, landscaped buffer; Primrose’s representative provided written agreement. Commissioners considered alternatives (landscaping cannot substitute under the prior code) and approved the waiver 5–2.
Each approval will be placed on the City Council agenda for first reading on Sept. 23. The commission’s agenda noted that approvals at the P&Z level are recommendations; final decisions rest with Council.
