Mentor City Council adopted a draft set of findings of fact and conclusions of law related to the administrative denial of a conditional use permit (CUP) for an express car wash.
Law Director Joe explained that the denial is an administrative act and, if the applicant chooses to pursue judicial review, the proper remedy is a 2506 appeal to the Lake County Common Pleas Court. No appeal had been filed at the time of the meeting. The draft findings were presented to the council, which moved, seconded and approved their adoption by roll call.
The council noted that the findings need not be acted on immediately but that adopting them now satisfied local rules in case an appeal is filed and established the record that would be used in court proceedings.
