Commission backs language to align appeals process with state law; zoning administrator rulings presumed correct

The Newport News Planning Commission on Aug. 6 recommended City Council adopt zoning-text amendment ZT2025-0003 to align the city’s appeals language with changes made by the Virginia General Assembly. Staff said the amendment clarifies that determinations by the zoning administrator or other administrative officers are presumed correct on appeal to the Board of Zoning Appeals and that the burden of proof rests with the appellant; the amendment also clarifies the order of evidence presentation.

Miss Hall and other staff said the change mirrors state code language to reduce ambiguity and to make hearing procedures transparent. A staff speaker emphasized the presumption can be overcome by evidence presented to the Board of Zoning Appeals and that an appellant retains the right to pursue judicial review in circuit court following local adjudication.

During public comment, David Smallridge asked whether the zoning-text change could alter proffers attached to prior rezonings; staff clarified that proffers are specific to a rezoning and that changes to proffers would require separate legislative action by City Council. The Planning Commission voted 8–0 to recommend adoption and scheduled the item for City Council consideration on Sept. 9, 2025.

If adopted by City Council, ZT2025-0003 will expressly reflect the state-law presumption in local ordinance language and will standardize the order for presenting evidence in local board hearings.
