Council moves into closed session citing litigation and a PPEA proposal

At the end of the public work session Vice Mayor Moody moved that the Portsmouth City Council convene a closed meeting under Virginia Code §2.2‑3711(a)(7) to consult with legal counsel about pending litigation and under §2.2‑3711(a)(6) to discuss the investment of public funds in connection with an unsolicited PPEA proposal.
"I move to go into a closed meeting pursuant to Virginia code subsection 2.2‑37 11 a 7 for the purpose of consultation with legal counsel pertaining to actual litigation ... and pursuant to Virginia code subsection 2.2‑37 11 a 6 for the purpose of discussion of the investment of public funds ... specifically regarding the unsolicited proposal received under the PPEA," Vice Mayor Moody said when making the motion. The motion was seconded and the clerk called the roll. Present members answered affirmatively and the council adjourned to a closed session; the meeting was set to reconvene at 7:30.
The motion identified litigation in Portsmouth Circuit Court involving Grifs Restaurant and Sports Lounge and JDF Holdings, LLC (case CL25001466‑00) and Swenson Restaurant Group (case CL25001599‑00). The motion and roll call were recorded in the public minutes prior to the closed meeting.
