Commission recommends annexation for 7736 Birch Lane after applicant cites county zoning enforcement

The Nampa Planning and Zoning Commission voted Sept. 23 to recommend annexation of 7736 Birch Lane to the city and apply RS-8.5 zoning.
The agenda listed the request in the names of Joshua and Michelle Reumann. An applicant identifying himself as "Josh Josh Ruman" said he and his wife bought the adjacent lots in December 2021 and later learned the parcel had been improperly zoned in 1986–87. He told the commission that "Canyon County is now stating that we are in noncompliance, and they will involve the Canyon County prosecuting attorney in effort to gain compliance if we do not annex into the city." That claim was presented by the applicant but was not adjudicated during the meeting.
Principal planner Christie Watkins recommended approval, saying the parcel is an enclave, is contiguous to city limits, and fits the medium-density residential designation in the Nampa comprehensive plan. Watkins noted engineering had provided standard comments and conditions; the recommended zoning was chosen to fit minimum and maximum lot-size rules so future development would be feasible.
Commissioners asked about why RS-8.5 (rather than RS-6) was proposed; staff replied the lot's size exceeds RS-6 maximums and RS-8.5 was the appropriate fit within the comprehensive-plan designation. The public hearing drew no opposition. The commission moved, held a roll-call recommendation vote, and the motion carried.
The commission's recommendation will be forwarded as the next procedural step following the city's review process.
