Tyker said the original agreement was intended to be an annual arrangement but a "scrivener's error" omitted that language. "When we entered into that agreement, we were both under the understanding that this was to be a continuing agreement. We missed a just a slight word. This is Scrivener's error. It was supposed to be per year," Tyker said.
Tyker said the city has been one year into the agreement and that the contract may be terminated at any time. Several councilors voiced concurrence with the amendment request; the transcript records verbal concurrence but no formal motion or recorded vote on the amendment during this meeting.
The council had earlier pulled a separate item (a request tied to a local MIRL grant program) to allow Casita staff more time for fiscal review; Tyker said more information was needed before action on that request.
