Police commission reviews FDRB findings, hears OIS summaries and votes to keep closed-session discussion private

The San Francisco Police Commission on Oct. 1, 2014 reviewed recent officer-involved shooting (OIS) cases and the status of ongoing investigations, and voted to hold and not disclose a related closed-session discussion.
Sergeant John Crudo of the Internal Affairs Division presented the third-quarter Firearm Discharge Review Board summary and accompanying memoranda, saying the board considered four completed OIS investigations (cases referenced as 11-07, 12-002, 12-005 and 12-006) and that each of those four "were found to be in policy." He described 11-07 as a Dec. 14, 2011 incident on Larkin Street in which officers pursuing a driver were fired upon and an officer returned fire; Crudo said the shooting was found to be in policy. He summarized 12-002 (May 13, 2012) in which a sergeant fired one round in defense after a suspect pulled a weapon, and said that incident was also found to be in policy. He reported that 12-005 and 12-006 (August and September 2012) likewise were found in policy.
Crudo told commissioners the department had 16 open OIS investigations as of Sept. 25, 2014, and that nine investigations were under review with the district attorney's office awaiting charging decisions. He said a tentative date for the next FDRB was Jan. 13, 2015.
Commissioners repeatedly praised Crudo and the IA team for clearing older cases and for thorough documentation; one commissioner noted that the packet included four summary letters and Crudo confirmed the summary letters had been submitted and included.
Earlier in the meeting Chief Gregory P. (as recorded) briefed the commission on two recent incidents, including a multi-county carjacking that ended in a crash and a separate Park Presidio incident resolved without lethal force, and referenced a recent town hall on officer-involved shootings.
Following public and staff reports, the commission voted to move a later agenda item into closed session for matters related to litigation and personnel. When the body returned to open session it considered whether to disclose any or all discussion held in closed session under San Francisco Administrative Code —7.12(a) and approved a motion "not to disclose." The motion to hold the item in closed session and the later motion not to disclose were both seconded and passed by voice vote in the meeting record.
What happens next: Crudo's report identified ongoing DA reviews and open investigations; commissioners encouraged staff to continue clearing backlogs and to report on any obstacles to timely completion. The commission scheduled its next meeting for Oct. 8, 2014.
