Police Commission adopts amended findings in Inspector Frank S. Lee disciplinary case

The San Francisco Police Commission voted unanimously on Nov. 13 to adopt amended findings of fact in the disciplinary matter involving Inspector Frank S. Lee (case numbers KM0C10032, MCD15409, IAD26909 and IAD2010047).

Commission counsel presented proposed findings and a set of edits the commission agreed to in closed session. The amendments included correcting a cross-reference in a footnote, inserting the phrase ‘‘in sustaining this specification, it is derivative that,’’ into paragraph 38 and paragraph 55 of the draft findings, and changing a reference from Department General Order 2.01 rule 10 to Department General Order 11-01. Commissioner Marshall moved adoption of the findings as amended and the motion passed with all present commissioners voting "Aye."

Inspector Frank S. Lee had requested a continuance to prepare a written response after receiving a recent draft; the Department opposed a continuance, saying proposed findings had been available for months. The commission reviewed inspector Lee’s two-page submission and discussed the matter in closed session before returning to open session to adopt the findings.

Department counsel John Alden spoke for the department; commission counsel read the edits the commission adopted. The commission recorded the vote in open session and announced the findings were adopted. The meeting record shows the commission considered whether to disclose any or all of the closed-session discussion under San Francisco Administrative Code section 67.12(a) and subsequently moved on that item as well.
