The San Francisco Police Commission on Oct. 19 adopted findings of fact and dismissed a patrol special officer, Robert Burns, in disciplinary matters heard before the commission in June 2011.
Counsel and the deputy city attorney presented a red-lined draft of the findings that included clarifying edits and citations to hearing exhibits. Counsel said the edits did not change substance but clarified the record. Commissioners recused two members who had not participated in the original hearing; Commissioner Petra de Jesus and Commissioner Julius Terman were recused after each indicated they had not taken part in the June proceeding.
A motion to adopt the findings was moved and seconded and the remaining commissioners voted in favor. The chair announced the dismissal of the patrol special officer in open session. Deputy city counsel and the hearing officer thanked staff and counsel for their work to prepare the findings for possible court review.
Next steps: The record, as adopted, may be used in any subsequent court proceedings or administrative follow-up; the commission confirmed it will follow established procedures for the disciplinary file.
