Police commission votes: move to closed session, unanimously recommend Maestrini settlement, accept 49ers donation

The San Francisco Police Commission on Oct. 28 voted to retire briefly into closed session and later recommended that the Board of Supervisors approve a settlement in Marco Maestrini v. City and County of San Francisco (U.S. District Court No. C07-2941).

Chair Joe Marshall called the meeting into closed session under the meeting’s Item 7, citing a conference with legal counsel on the Maestrini litigation and several personnel exceptions related to disciplinary cases. Commissioners then reconvened in open session at 7:36 p.m. and voted to withhold disclosure of closed-session discussions; a motion for nondisclosure was moved and seconded and the chair ruled it "so ordered." (Commissioners did not disclose details of closed-session deliberations on the record.)

Under the consent calendar (Item 9a) the commission moved to recommend that the Board of Supervisors approve the proposed settlement in Marco Maestrini v. City and County of San Francisco. The clerk called the roll for the recommendation and the chair announced the motion “carries unanimously.”

Also on the consent calendar (Item 9b) the commission approved a request to accept a donation from John York — described in the record as four team hats and eight tickets to a San Francisco 49ers game — that had been made to officers at Ingleside Station. The matter was approved on the floor; the clerk later noted the item was approved "with 1 abstention" (the transcript does not specify which commissioner abstained).

Earlier in the meeting the commission adopted prior meeting minutes by motion and without objection.

The commission adjourned at 7:39 p.m. after a motion to adjourn in honor of recently deceased Officer Napoleon "Sonny" Hendricks.
