Police commission declines to sustain intimidation charges against Lt. Jerry Langford

The San Francisco Police Commission considered disciplinary charges against Lieutenant Jerry Langford and, after closed-session deliberations, declined to sustain the intimidation allegations.
Commission records show a written motion to dismiss was considered; the full commission reviewed the motion and, after closed-session review, unanimously denied the motion to dismiss. The commissioners then reviewed the substantive record and concluded that the department had not met its burden of proof. "For reasons that we did not feel the department met the burden of proof, we unanimously did not sustain the charges against officer Langford," President Sparks announced after the commission reconvened in open session.
The hearing included written closing briefs from both sides and remarks from counsel for the charged officer, Eileen Burke. The commission noted the seriousness of intimidation allegations and said testimony from the officers who testified was "courageous and compelling," but found the evidence insufficient to sustain the charges. Commissioners also voted to withhold disclosure of closed-session deliberations.
The commission earlier removed another disciplinary matter (case C09-044) from the calendar after staff reported the charged officer had retired; the charges remain on file and could be returned to the calendar should jurisdiction be re-established.
No further disciplinary decisions were announced at adjournment.
