Commission assigns disciplinary charges, hears public support for Patrol Special Officer Hanley Chan and votes not to disclose closed-session discussion

The San Francisco Police Commission announced assignments of disciplinary charges in two cases and then retired to closed session for legal and personnel matters.

Under Item 5a, staff announced disciplinary charges in case number C08-090 would be assigned to a commissioner for taking evidence on a date to be determined. The commission also announced charges filed against Patrol Special Officer Hanley Chan (file C08-091) and assigned that matter to Commissioner Thomas Mazuko for a hearing date to be set.

During public comment on the disciplinary items, multiple community members spoke in support of Chan, saying he has been a helpful presence in neighborhoods and asking the commission for a fair and speedy process. Speakers included an executive who described Chan’s community contributions, Michael Moon (vice president of an organization for Chinese Americans in San Francisco), Ron Lee, and others who said Chan performs community policing and serves as a resource to local businesses and nonprofit groups.

The commission voted to hold a closed session under Government Code section 54956.9 and San Francisco Administrative Code section 67.1(b) to confer with legal counsel regarding threatened litigation related to promotions and assignments. The commission later reconvened in open session and voted to withhold disclosure of the closed-session discussion; the motion for "non disclosure" was moved and seconded and passed without objection.
