City staff briefed council on a request to rezone 1111 East Garrison from O-1 (office) to C-1 (neighborhood business). The item arrived on council because the Planning Commission’s 5–2 vote fell short of the 3/4 majority required to finalize a general rezoning.
Planner Maddie Gates told council that C-1 allows a broad array of neighborhood-oriented commercial uses and that a general rezoning would require the council to consider all permitted C-1 uses. Applicant representative Brian Maielli said the intent is to open a second location of an Italian-ice business his family operates; he described prior community involvement and charitable partnerships. Council members raised concerns about setting a precedent for general rezoning in an office area and noted that conditional rezoning could allow the applicant to specify permitted uses and protections for neighbors.
Council voted unanimously to continue the public hearing to the Jan. 21 meeting so the applicant can discuss options with staff — either to withdraw and refile as a conditional rezoning or to continue as a general rezoning with a revised plan.
