LAFCO extends Miller & Owen legal contract with $45,000 not-to-exceed amount

LAFCO authorized an amendment to its legal services agreement with the Miller & Owen firm, extending the contract to June 30, 2015 and approving a recommended not-to-exceed amount of $45,000.
Jason Fried, LAFCO staff, explained the recommendation as a conservative estimate tied to reduced workload and a board-of-supervisors request for cost savings. "Last year, we had approved a not to exceed rate of $95,000 but based on...the workload... staff is recommending an amount of $45,000," Fried said. He added the agreement includes standard termination provisions and that staff will monitor use and return to the commission if the amount needs to be increased.
The motion to approve the extension and modest rate increase was brought forward by the commission and seconded; the item passed without objection. Commissioners thanked Lisa Miller for continuity and said the reduced not-to-exceed figure and modest rate increase are reasonable given anticipated workload.
The commission did not specify line-item budget adjustments at the meeting; Fried said the contract may be revisited midyear if unanticipated work arises.
