The LAFCO Commission voted to extend the contract for interim executive legal services provided by Nancy Miller and set a $75,000 not-to-exceed ceiling to align the contract with historic usage.
Jason Fried, LAFCO staff, told commissioners the staff recommendation had proposed a $95,000 ceiling but that actual spending in recent years has been lower. "If you average it out, it should come to about $70,000 by the time this year is over," Fried said, citing historical totals and current-year estimates. He added the firm bills by the hour and "we only use her services when we need it, so it's an as-need services" arrangement.
Commissioners pressed staff on budget treatment of the contract savings. Fried said most of the contract costs are charged to the CCA budget, with roughly $2,000 charged to the general fund so far this fiscal year. After discussion, an unnamed meeting leader moved to reduce the not-to-exceed amount to $75,000; Commissioner Marr seconded and the motion carried without objection after public comment was opened and no members of the public spoke.
The extension preserves the commission's ability to terminate the contract with notice, and staff emphasized the change does not obligate the commission to spend to the ceiling and that hours can be adjusted to fit the lower limit. The item will be reflected in the commission's contracting records and related budget lines.
