At its meeting the Local Agency Formation Commission discussed administrative items including appointments and compliance obligations and voted to convene a closed session on pending litigation.
Nancy Miller, interim executive officer, reviewed administrative reminders: Form 700 financial disclosures are due by April 1 and staff will return with a documented outreach plan on marketing and notices. When Item 8 (appointments) was called, Miller reported two applications for the public member seat and none for the alternate. Commissioner Dufty proposed continuing the appointment for one month to encourage broader outreach for applicants; several commissioners agreed and the commission continued the item, leaving incumbents in place until a new appointment is made.
When Item 5 was called, Chair Ross Mercurimi moved that the commission convene in closed session "for the purpose of conferring with or receiving advice from legal counsel ... regarding existing litigation pursuant to Government Code section 549.56"; the motion was seconded on the record and the commission moved into closed session. On return to the public record the chair instructed participants not to disclose closed-session deliberations; the clerk then read Item 11 (adjournment) and the meeting was closed.
No formal roll-call vote tallies were recorded in the public transcript for the appointments-continuance action or the closed-session motion; the motions were entered on the record and implemented as announced.
