Entertainment commissioners report stepped-up inspections and flag persistent noise complaints

Senior Inspector Sean Burke told the San Francisco Entertainment Commission that staff have stepped up inspections and enforcement after new complaints at several venues across the city.
Burke said complaints led to follow-up at Rusted Mule (1217 Sutter) where a permit application was started but not completed, and at Gestalt (3159 16th Street), where inspectors determined an establishment had been operating without the appropriate permit. He reported an inspector’s visit to Jolene’s found that venue in compliance and that the noise source in that case appeared to be a nearby residential party rather than the venue.
Burke also said the Emporium was out of compliance with its internal sound limit, while The Independent remained compliant; staff issued a notice of violation to Emporium. At the Fillmore Heritage Center, he said complaints appeared to stem from patrons gathering outside after events rather than amplified music inside the venue.
Commissioners pressed Burke on recurring reports about Charmaine’s rooftop operations. Burke said a major enforcement challenge is anonymous complainants: “we don’t have the ability really to address these in real time,” he said, explaining anonymous reports limit staff follow-up because there is no contact information to trigger timely visits. He said staff plan to send Inspector Savino on weekend checks and to pursue sound measurements at times when the events are occurring.
Several commissioners recommended stronger neighborhood outreach and clearer security plans, and one suggested bringing chronically noncompliant venues such as Jones to a hearing if staff do not see sustained progress. Burke said Jones has multiple complainants — including a repeat known complainant and at least one new complainant — and staff are arranging a scheduled Sunday visit to measure levels.
Burke said staff are distributing a Good Neighbor Policy and will push outreach via email and social media; he also suggested better coordination with SFPD to help respond to weekday complaints. Commissioners said they value the more detailed report format and expanded enforcement presence and encouraged staff to continue pursuing compliance.
