Commission continues Basement (222 Hyde) permit after police and supervisor’s office urge probationary hours

The commission voted to continue the application for a place-of-entertainment permit for 222 Hyde (the Basement) to the Nov. 18 meeting after a contentious hearing in which police and the supervisor’s office recommended a probationary restriction on entertainment hours.
Applicant Larry Livingston described plans for a lounge with DJs and said he had secured a 47/48 (beer and wine) license and had installed cameras and lighting to improve the corner. Officer Torres, representing Captain Jason Chernis of the Tenderloin Police Station, told the panel the location previously operated as a nightclub and produced a “high volume of calls for service” in past years; he recommended limiting entertainment during an initial review period because of the site’s history and small footprint.
Lieutenant Dave Falzon said recent trends show applicants attempting to renegotiate previously agreed conditions at the eleventh hour and urged the commission to protect community agreements. Sunny Angula from Supervisor Jane Kim’s office said the PCN (Police Community Notification) resolution agreed by the supervisor’s office and the neighborhood included a commitment that "sales of alcoholic beverages shall be permitted between the hours of 11AM and 12AM Sunday through Wednesday, and 11AM till 12AM on Thursday through Saturday for the first 6 months." She recommended the commission apply a probationary midnight-closing condition to entertainment while police and the operator build a working relationship.
Community members, including residents living near Turk and Hyde, urged caution and opposed live DJs until the operator demonstrates reliable mitigation of noise, loitering and other neighborhood impacts. Commissioners said they were concerned about the applicant’s lack of experience operating nightclubs in San Francisco, the size of the proposed sound system and the site’s narrow footprint; several commissioners supported a continuance to allow the applicant, the police and supervisor’s staff to come to a final agreement. The motion to continue to November 18 passed.
