By unanimous vote after a closed deliberation, the commission announced it would “uphold the 10 day suspension” and instructed the department to prepare proposed findings of fact, which will be provided to the affected firefighter and returned to the commission for final approval. The panel then voted not to disclose discussions beyond the decision announced in open session.
An attorney who called in during public comment, David Garcia, said his client had been assaulted in the incident and asked commissioners to remove a finding of violence from the record and reduce the penalty. Garcia told the commission his client had “no prior discipline” and had attempted to de‑escalate the encounter. The attorney declined to name the parties for privacy reasons.
The commission’s open‑session statement referenced California Government Code section 54957(b) and San Francisco Administrative Code section 67.1(b) as the legal basis for the closed deliberation. The department will draft proposed findings of fact for the commissioner office to review and adopt at a later meeting.
The decision was the formal action recorded at the end of a regular commission session that included reports from department operations, EMS and employee health.
