The Ethics Commission voted to adopt its annual report as amended and took procedural votes to address an anticipated litigation matter in closed session.
Adoption of annual report: The Commission considered corrections to the report (including date corrections to Commissioner Keene’s service record) and an amendment to add a future-initiatives bullet referencing civil grand jury recommendations. A Commissioner moved and another seconded the adoption; the chair called a voice vote and the motion passed.
Closed session and confidentiality: The Commission then moved to go into closed session pursuant to the Charter, the Brown Act and the local Sunshine Ordinance to discuss a matter in which the Commission anticipated being a plaintiff in litigation. The motion to enter closed session passed on a voice vote. After returning to open session the Commission voted to keep the closed-session discussion confidential.
Other routine actions: The Commission adopted the July and August minutes as amended (a correction to the August minutes' phrasing was noted) and adjourned the meeting by voice vote.
Procedure note: The meeting record shows these votes were taken by voice and the transcript records the outcome as passed; the record does not include a roll-call tally in the public portion of the transcript and no formal investigation or substantive policy decision on the pending complaints was taken during open session.
