Ethics Commission schedules Pastor Gavin Sunshine complaint for September, limits further continuances

The San Francisco Ethics Commission voted to continue a Sunshine Ordinance complaint involving Pastor Gavin to its September meeting and to require a showing of good cause for any further continuance.

The motion, made during public session, directs staff to place the item on the September agenda and records that the continuation is made at the complainant’s request. Commissioners said the measure balances the complainant’s need for accommodation with the commission’s duty to resolve referrals promptly.

Commissioner Hur moved to continue the matter to September and Commissioner Stedley seconded. Commissioners debated whether to require a doctor’s note or other documentation; the adopted motion states no additional continuances will be granted for either side absent a showing of good cause. The motion passed.

Public commenters urged sensitivity to the complainant’s circumstances. Ray Hartz, director of San Francisco Open Government, told the commission that Pastor Gavin has experienced homelessness and limited access to health care and that “asking her to produce a doctor’s note when she has no access to a doctor is an unreasonable expectation.” Other members of the public and commissioners emphasized the need to avoid repeated delays while allowing reasonable accommodations.

The continuation preserves the parties’ options: the complainant may appear at the September hearing, appear through a designated representative, or request other procedural accommodations. The commission recorded its reasons for the delay in the minutes and instructed staff to schedule the item for a date certain in September.

Next steps: the item will be placed on the September Ethics Commission agenda; the commission’s minutes will reflect the condition that additional continuances require a showing of good cause.
