The chair announced the commission invoked the attorney–client privilege under Government Code section 54956.9 and Administrative Code section 67.10(d) to consider the item in closed session. After reconvening in open session, the commission reported they had agreed to a settlement and said they would pass the settlement to the Board of Supervisors for final approval. The commission then moved and voted by voice not to disclose the substance of the closed‑session conversation.
The actions were announced during the meeting but the commission did not disclose litigation details during open session, citing the attorney‑client privilege. The settlement will proceed through the Board of Supervisors for final approval as required by city procedures.
