Abatement board upholds order for 1139 Guerrero Street after inspector cites unresolved wall‑heater violation

The Abatement Appeals Board unanimously upheld an order of abatement for 1139 Guerrero Street on Aug. 21, 2019, after city inspectors said required repairs had not been completed.
Mauricio Hernandez, chief building inspector for code enforcement, told the board that a plumbing inspection prompted a complaint on Dec. 6 and a notice of violation was issued Dec. 9. Hernandez said the department later issued a final warning when the property failed to obtain the required building permit; a permit was issued roughly two months later. Hernandez said a director's hearing took place in December 2018 and the owner requested a continuance to obtain a plumbing permit. He said inspectors recorded no on‑site contact during an attempted inspection on Feb. 7, 2019, and that while some April inspections show partial corrective work, the wall heater remained incorrectly installed and posed a safety concern.
Hernandez asked the board to uphold the order of abatement and impose assessment costs, citing multiple, repeated violations at the property and a lack of corrective action. There was no public comment and the appellant, listed in the record as Renka Properties LLC, was not present for the hearing.
A member of the board moved to uphold the order and assess fees, the motion was seconded, and the board conducted a roll‑call vote. All voting members present voted yes and the chair announced the motion carried unanimously. The board’s action affirms the department’s order and permits the city to assess the abatement costs against the property.
At the same meeting the board also approved the minutes from its July 17, 2019 session and then adjourned; it was scheduled to reconvene as the Building Inspection Commission at 10:00 a.m.
