Board denies rehearing for 3515 Santiago Street after inspectors report no permit activity

The Abatement Appeals Board unanimously denied a petition for rehearing in the long‑running abatement case at 3515 Santiago Street.

DBI staff told the board that the initial complaint in the case originated about a year earlier and that multiple reinspections since the last AAB hearing had been canceled by the owner before inspectors could verify progress; staff reported no active permits and no substantial work since the prior director’s hearing. Rosemarie Boskey, chief housing inspector, said the notice of violation contained 16 items, many unrelated to the current permit activity, and that staff had not seen evidence of meaningful progress toward compliance.

Appellant Mary Lou Sampson said she had appointments canceled while waiting for an electrician, described prior permit activity for two bathrooms and revisions she filed, and explained financial and scheduling constraints that slowed work. She asked the board for additional time and expressed willingness to meet staff after the hearing.

The board’s City Attorney asked whether the petition presented new evidence or demonstrated legal error; commissioners agreed it did not. A motion to deny the rehearing on the basis that the appellant had not come forward with new evidence carried on a unanimous roll call.

The denial leaves the prior order of abatement and its conditions in place; staff told the board they will continue to seek compliance or enforcement steps as appropriate.
