Shipyard residents press OCII to make Lennar appear and explain marketing of open space

Residents of the Hunters Point Shipyard urged the commission on Oct. 3 to require Lennar to appear in person to explain marketing materials and sales representations that residents say indicated that portions of Blocks 52 and 54 would be parks.
Eric Vanderpool, a shipyard homeowner, said Lennar sales representatives and marketing materials showed the contested parcels as parks and that Lennar's attorney's written response did not address residents' concerns. "We're not here to determine whether Lennar can legally, quote, refute claims that there were insufficient disclosures, unquote," Vanderpool said; "that will be handled in a court of law. It doesn't matter whether what Lennar did was legal or not, and there is strong indication that it was not legal, but something can be lawful and still be awful."
Other residents echoed the call for action. Shannon Hetrick said purchasers were "sold to park on those lots" and that the representation affected purchase decisions; David Springer and Jason Fried also urged the commission to hold Lennar accountable and to conduct a public hearing, possibly at a time and place accessible to shipyard residents.
Commissioner Rosales said the written response from Lennar was "non responsive" to the commission's earlier request and proposed calendaring the matter for a future informational discussion with Lennar asked to attend so commissioners could address questions directly. Commissioner Singh seconded the motion. The commission took a roll call and voted 5-0 to place an informational item on a future agenda requesting Lennar's attendance and to allow a fuller discussion.
The commission did not take further action at the meeting; staff will place the item on a future agenda per the motion.
