The Abatement Appeals Board on Nov. 18 upheld an order of abatement for an unpermitted roof deck at 2246 Greenwich Street but reduced the fees and gave the owner time to complete final inspection procedures.
DBI staff reported that an order of abatement was issued after a May 2014 hearing and that a permit to remove the unpermitted roof deck had been obtained but remained unsigned because the final inspection had not yet occurred. DBI said that if the permit work is signed off the violation would be cleared.
Owner Rayetta Kroll told the board she removed the deck after a prolonged and costly attempt to legalize it through Planning and Building processes and submitted photos of the demolition; she said she has a final inspection scheduled for the following Monday. “We have removed the deck...I brought pictures to show that the deck has been removed,” she said.
Commissioners discussed the appropriate fee given the lengthy process; DBI cited an initial abatement fee of $13.14 accrued up to the point the order was issued. Commissioner Walker moved to uphold the order of abatement, reduce fees by half and allow 30 days for final inspection so closure can occur if the work is signed off; Commissioner Marr seconded. The board approved the motion unanimously.
The reduction in fees and the 30-day allowance are intended to recognize the owner’s multi-year effort to comply while preserving DBI’s enforcement authority if the final inspection is not completed.
