The Building Inspection Commission voted unanimously Wednesday to support legislation from Supervisor Scott Wiener’s office that would require written and posted notice to all tenants when a dwelling unit is proposed for demolition or merger.
Andres Power, representing Supervisor Wiener, told commissioners the current code treated tenants in legal and unwarranted units differently: tenants in permitted units receive formal advance notice and appeal rights, while occupants of unwarranted units often receive no advance notice and learn of eviction only when contractors arrive. The ordinance (Board of Supervisors file 150,587) would align Building and Planning Code notice and affidavit requirements so all tenants get the same information and appeal opportunities.
Commissioner Walker and others supported the measure, saying it levels the playing field and ensures due process for tenants regardless of the legal status of a unit. The commission moved, seconded and recorded a unanimous roll call vote in favor of recommending support for the ordinance.
The item will proceed through the Board of Supervisors process. Commissioners and staff noted the code advisory committee had reviewed the proposal (the committee’s recommendation was included in the packet).
