Building Inspection Commission reinstates CFC for 1142 Guerrero; hears community concerns over Candlestick demolition dust and get Accela update

The Building Inspection Commission voted 5–1 April 15 to reinstate a Certificate of Final Completion and Occupancy for a rear unit at 1142 Guerrero after the tenant and owner executed a settlement contingent on reinstatement and DBI staff reported the unit was habitable and largely code‑compliant.
DBI staff summarized permit and record searches and acknowledged a CFC may have been issued in error in 2014. Counsel for the parties told the commission the tenant would withdraw objections if the CFC were reinstated; after discussion commissioners voted to overturn the director’s revocation and reinstate the certificate. The commission was advised it must issue written findings within 90 days.
The commission also held an extended hearing on the Candlestick demolition project. DBI, the Department of Public Health, the Bay Area Air Quality Management District and OCII described roles and monitoring plans: DPH reviews and approves dust control plans and analyzes PM10 and asbestos monitoring data; BAAQMD inspects asbestos removal and enforces dust and diesel regulations; DBI inspects visible dust and may stop work for permit noncompliance. Lennar described a hotline, third‑party monitors and amendments to the dust control plan.
Community members pressed for more monitors near Bret Harte Elementary and Ignacio Avenue, requested multilingual signage and easier public access to monitoring data, and reported dust tracked into homes. DPH and BAAQMD said they review monitoring data and send inspectors when exceedances occur; DBI said its inspectors perform spot checks for visible dust and can stop work or suspend permits for noncompliance. Commissioners asked DBI to continue frequent site checks and to return with updates; several commissioners requested a site visit to verify monitor location and functioning.
DBI’s technology team reported progress on the Accela permit‑tracking replacement: configuration down to 21 critical functional items, final data migration runs planned for late April/early May, and end‑to‑end simulations targeted for mid to late May before a go‑live decision. Commissioners approved Administrative Bulletin AB004 (priority permit processing) and continued discussion of AB094 (soft‑story voluntary seismic upgrade guidance) for further technical and CAC review.
