Abatement Appeals Board grants three-month continuance in Twelfth Avenue property dispute pending JAMS arbitration

The Abatement Appeals Board voted unanimously on Feb. 15, 2012, to continue an abatement case involving property at 1743 Twelfth Avenue for three months to allow a binding arbitration process to conclude.
Christine Tursakis, attorney for the appellant, told the board the parties had completed a three-day binding arbitration session at JAMS and that briefs were being submitted to the arbitrator. "It is anticipated ' we're hoping that this would be resolved earlier than three months, but we're asking for three months because as you may know, things at the arbitration do not go as fast as we anticipate sometimes," Tursakis said.
Reuben Becker, attorney for the adjacent lower-lying neighbor, said multiple counsel and insurers were involved and joined the request for a three-month continuance, calling it "economical and useful." The board then moved to grant the continuance and took a roll-call vote that carried unanimously.
The continuance preserves the parties' ability to resolve underlying disputes through the arbitration process before the board resumes testimony and deliberation.
