The Abatement Appeals Board unanimously upheld a director’s order of abatement for 2455 Jackson Street after staff presented evidence of an unpermitted extension and multiple expired permits that remained unresolved.
Billing inspector John Hinchon described the case history: notices of violation beginning in 2007, a director’s hearing that produced Order No. 103438-A, and inspections showing an extension on the west roof outside scope of issued permits. Staff recommended upholding the order and assessing costs.
Attorney Michael Anthony, representing the property owner, argued the enforcement was unfair and that subsequent inspections and permit actions corrected the issues. A senior building inspector recounted site visits and said framing found in a light-well area was addressed by a permit taken out in June; he nevertheless noted other expired permits and remaining life-safety concerns such as debris and fire-loading that needed resolution.
After discussion, the board moved to uphold the department’s abatement decision. A roll-call vote recorded unanimous support for upholding the order of abatement; the board indicated this finding was based on the director’s decision and the outstanding condition of the property.
The board’s action leaves the director’s abatement in place and signals that the owner must complete permit sign-offs and remedy outstanding life-safety issues to resolve the case.
