SFUSD proposes tiered facilities-use fees and approves updated facility rental rates while deferring charter MOUs

District staff presented a multi-phase plan to modernize facilities-use permits, introduce an online application and adopt a tiered fee structure intended to make permits cost neutral while preserving discounted access for programs serving SFUSD students.
Elizabeth Lee, Real Estate Manager, described a UC Berkeley Center for Cities and Schools analysis that underpins a four-tier structure: Tier 1 (district or PTA events) would receive a 100% facilities discount and pay only staffing costs; Tier 2 (external programs serving students — at least 75% SFUSD participants) would receive a 50% facilities discount but pay staff costs; Tier 3 (community/nonprofits) would receive a 10% facilities discount; Tier 4 (private/commercial users) would pay a fair-market rental rate. Staff emphasized that all user groups must cover staffing costs and that private/commercial rates could subsidize discounts for student-serving groups.
Separately, the board considered ratification of charter school memoranda of understanding (MOUs) and facilities-use agreements. Staff noted a substantive change in charter MOU language: the local general fund contribution for special education was lowered to $163 per ADA from a previous $500 figure, intended to retain revenue and prevent charters from leaving the district's SELPA. Commissioners asked for a fiscal analysis of the change and asked that MOUs be reviewed in the Rules Committee. The board voted to approve the facilities-use agreements (roll call recorded as 7 ayes) and to defer the charter MOUs to the Rules Committee for additional review. Staff acknowledged operational concerns such as custodial overtime and summer/outdoor scheduling that will inform final fee settings and system phasing.
