The Planning Commission on Thursday approved a conditional use authorization allowing the Mission Street bar Casements to continue using an approximately 1,800‑square‑foot outdoor activity area and to add a nighttime entertainment use, subject to conditions limiting outdoor hours and strengthening neighborhood communications.
Planner Maggie Loush presented the department recommendation to limit outdoor operating hours to 9 a.m.–10 p.m. to reduce potential noise impacts to nearby residents and hotel units directly above the site. The staff report noted 50 letters in support and three letters of opposition and described outreach by the sponsor.
Applicant co‑owner Chris Hastings said the patio was vital to his business’ survival and community programming and requested later hours — 11 p.m. on weekdays and midnight on weekends — to maintain economic viability and host community events. "To lose this space would be to lose, probably close to half of our workforce," Hastings told commissioners.
Public comment was sharply divided. Numerous trades and nonprofit representatives spoke in favor, emphasizing local hiring, community events and accessibility for older residents; many neighbors urged strict limits, describing persistent late‑night amplified sound, party behavior in the adjacent parking lot and unsuccessful attempts to reach bar management. Several neighbors asked the commission to adopt the staff‑recommended 10 p.m. cut‑off and to ensure a reliable point of contact for complaints.
Commissioners debated the practicality of an on‑site coordinator but agreed the project sponsor must provide community contact information and a community liaison who must report unresolved complaints to the zoning administrator. Commissioner Brown moved to approve with the staff‑recommended outdoor hours; Commissioner Imperial seconded and the commission voted 5–0 to approve the CUA with the conditions discussed.
The authorization allows the outdoor activity area to continue under the conditions set by the commission and does not change the city’s entertainment permitting process; the sponsor indicated it will pursue entertainment‑commission permits for ongoing events where needed.
