The San Francisco Planning Commission unanimously approved a project on Jan. 20, 2022, to remove an unauthorized dwelling unit at 64–66 Deming Street and to legalize certain interior work, returning the building to two legal dwelling units.
Planning Department staff said the unauthorized unit, described in the packet as "4 68 square foot" (as transcribed), would be removed and converted back to tenant storage, and the proposal includes legalization of a full bath and infill of two windows installed without permits. Staff noted a typographical error in the draft motion and corrected the recorded date of vacancy to April 17, 2016. The department reported no public comment on the item prior to the hearing.
Project sponsor architect Tony Ponteleone represented the owner and explained the intent to bring the property into compliance with building code and planning enforcement findings. Commissioners questioned the bathroom definition and minimum ceiling heights; staff and the architect clarified that bathrooms are shown with sink, toilet, and shower and that a 7-foot head height for bathrooms is allowed, while living-space minimums differ; the project will require building-department sign-off to close out permits.
A motion to approve the plans with corrected language and conditions passed unanimously 7–0.
