The Planning Commission approved a discretionary review and related variances for 945–947 Minnesota Street on Oct. 22 after technical debate over unpermitted rear structures and rear‑yard encroachment calculations.
Spencer Ghosh, the Doctor requester and a former building inspector who lives behind the subject property, urged the commission to require removal of what he characterized as illegal rear structures and said he found numerous planning‑code violations in the permit history. “The new developer owner of 945 Minnesota Street is attempting a de facto legalization and expansion of illegal structures,” Ghosh told commissioners, saying he had submitted briefs documenting his concerns.
The project sponsor/contractor, Suhail Shatara, said the work began with a remodel permit, that foundation replacement was required because of settlement, and that the team pursued historic‑district approvals and variances as necessary; Shatara also said he had building permits and offered Mr. Ghosh an opportunity to review them in person.
Planning staff and technical advisors explained the rear‑yard averaging method applicable to this lot (because it abuts a through lot/school site) and said infill below an existing nonconforming structure generally does not require a variance; staff noted that reconstruction of stairs or rebuilding beyond 50% can constitute new construction requiring a variance. Planner Monica Giacomucci summarized the calculations and said the baseline rear yard for 945–947 Minnesota is about 33 feet under the applicable averaging approach.
After staff clarified the code analysis, the commission moved to approve the matter (not take the Doctor) and grant the requested approvals under the standard conditions; the motion carried unanimously, 5–0.
