The Planning Commission voted unanimously on June 6 to approve an in‑kind impact‑fee waiver of up to $3,000,000 for a new public plaza that the sponsor of the 30 Otis project will construct at the corner of Twelfth Street and South Van Ness in the Market Octavia area.
Planning Department staff explained that Align Real Estate proposes to deliver a pedestrian plaza with public art, a reflecting pool, seating, planters and a program of arts and music events in exchange for credit against Market Octavia infrastructure fees. Staff said the plaza, and related Twelfth Street improvements, implement recommendations in the Hub public realm plan and had undergone design review and multiple rounds of city feedback (DPW, SFMTA, city attorney) as well as meetings before the Market Octavia CAC, which passed a resolution supporting the waiver.
Sponsor representatives described the design team (Frida Escobedo and local landscape architect David Fletcher), noted outreach and support (147 supporters reported) and said the sponsor will assume maintenance and liability responsibilities, to be formalized through a major‑encroachment permit and maintenance covenant with Public Works. Commissioners asked how long the sponsor will maintain the plaza and what standards will apply; staff said maintenance responsibilities and materials standards will be defined in the major‑encroachment process with DPW.
The commission approved the waiver by roll call (Ayes: Johnson, Moore, Richards, Coppell, President Melgar), with conditions and standard major‑encroachment requirements.
Next steps: The sponsor will finalize plaza design details with DPW and execute a maintenance covenant and major‑encroachment permit before receiving the in‑kind credit.
