The consultant concluded the pergola and other measures would reduce patio sound sufficiently to meet applicable limits under San Francisco’s noise code under typical conditions, though neighbor‑hired consultants argued the setting’s tight geometry and reflections could keep levels near the allowable limit.
Public comment was split: dozens of immediate neighbors and property owners urged denial or stronger mitigation because of experience with noise amplification into adjacent residences; more than 1,000 petition signatures and many local merchants and patrons supported the patio as a neighborhood asset and urged approval with conditions. Commissioners weighed small‑business preservation and urban vibrancy against potential ongoing impacts for residents.
The Commission approved the conditional use unanimously (5‑0) with conditions including an occupancy limit for the patio, 10:00 PM closing, a requirement that Recology recycling pickup occur after 7:30 AM, documentation of implemented sound‑mitigation features, and a one‑year status memo to the Commission to review any complaints and mitigation effectiveness.
